1. Who Operates Harken
Harken is operated by Fortide Network and Data Solution, P24 Poblacion, Bayugan City, Philippines 8502. Hemisthia is the product family name used for Harken and related products developed and managed by Fortide Network and Data Solution.

2. Agreement
By using Harken, creating an account, using any app download we make available, or buying a paid plan, you agree to these Terms, the Privacy Policy, and the Refund Policy.
3. Accounts
You are responsible for the accuracy of your account information and for keeping your sign-in credentials secure. You must not use another person's account or allow unauthorized use of your account.
Harken product access requires a signed-in account. Anonymous product use is not supported.
4. Product Use
Harken captures and structures voice, meeting, image, and related context. AI output can be incomplete, inaccurate, or unsuitable for your specific use. You are responsible for reviewing output before relying on it.
You must not use Harken to break the law, violate privacy rights, upload content you do not have the right to process, abuse the service, reverse engineer restricted systems, or interfere with service availability.
5. Paid Plans And Billing
Free and paid plan details are described on the Pricing page and in your account. Paid subscriptions may be processed by Paddle or another merchant/payment processor identified at checkout. The checkout may include additional payment, tax, subscription, and buyer terms from that processor or merchant of record.
When Paddle is shown at checkout, Paddle.com acts as merchant of record for the order and handles buyer payment support, returns, receipts, and subscription payment questions through paddle.net.
Unless checkout says otherwise, paid plans renew automatically until canceled. Canceling stops future renewal charges; it does not create a refund for a current or previous billing period.
6. Refunds
Harken does not offer voluntary refunds, prorated refunds, or exchanges. Refunds are only available when required by applicable law, a merchant of record or payment processor policy, or a confirmed billing or product issue that Fortide Network and Data Solution chooses to resolve by refund. See the Refund Policy for the full policy.
7. Data And Privacy
Harken processes account, product, billing, audio, transcript, image, meeting, diagnostic, and support data as described in the Privacy Policy. Do not submit sensitive content unless you are comfortable with it being processed for the Harken features you use.
8. Service Changes
Harken may change, pause, remove, or limit features, plans, pricing, limits, or access when needed for product, security, billing, infrastructure, or legal reasons.
9. Ownership
Fortide Network and Data Solution owns Harken, Hemisthia product names, site content, software, workflows, and service design, except for content, trademarks, or materials owned by others. You keep ownership of content you submit, subject to the rights needed to operate Harken for you.
10. Termination
You may stop using Harken at any time. Harken may suspend or terminate access if you violate these Terms, create risk for the service or other users, or fail to pay for a paid plan.
11. Disclaimers And Liability
Harken is provided as-is and as-available to the fullest extent allowed by law. Fortide Network and Data Solution does not guarantee uninterrupted service, error-free output, or fitness for a specific purpose. Liability is limited to the fullest extent allowed by applicable law.
12. Governing Law and Disputes
Harken is operated by Fortide Network and Data Solution from the Philippines. Except where local law provides otherwise, these Terms and any dispute arising out of or relating to them or to Harken are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules, and the courts of the Philippines have non-exclusive jurisdiction.
Nothing in these Terms removes or limits any mandatory consumer-protection right, statutory right, or remedy you have under the laws of your own country or state of residence that cannot legally be waived by agreement. If you are a consumer, you may also be entitled to bring proceedings in the courts of your place of residence, and your local mandatory consumer law continues to apply to you regardless of the governing law stated above.
For United States residents: these Terms operate alongside, not in place of, the consumer-protection and other non-waivable laws of your state and of the United States. Where payment is processed by Paddle as merchant of record, Paddle's buyer terms and dispute process at paddle.net also apply to payment, billing, tax, and chargeback matters.

13. Updates
These Terms may be updated as Harken changes. The effective date above shows the current version. Continued use after an update means you accept the updated Terms.
